Terms of Service

By creating an account, installing a tool, purchasing a product, or otherwise using MCP Marketplace, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By creating an account, you represent and warrant that you meet this requirement.

You agree to:

• Provide accurate, current, and complete information during registration and keep your account information up to date.
• Maintain the confidentiality of your account credentials and accept responsibility for all activity that occurs under your account.
• Notify us immediately at support@mcp-marketplace.io if you suspect unauthorized use of your account.

Accounts may be created via email/password or through third-party authentication providers such as GitHub. You are responsible for compliance with any third-party provider's terms of service.

We reserve the right to suspend or terminate accounts that violate these Terms, remain inactive for an extended period, or are created with false or misleading information.

MCP Marketplace is a curated platform for discovering, distributing, and installing MCP (Model Context Protocol) servers ("Tools"). We provide the infrastructure for creators to publish Tools and for users to discover and install them.

While we perform security scanning on all listed Tools, we do not guarantee that any Tool is free from defects, errors, vulnerabilities, or malicious code. Users install and use Tools at their own risk.

We reserve the right to remove, delist, or restrict access to any Tool at our sole discretion, including but not limited to Tools that violate these Terms, pose security risks, or receive credible complaints.

MCP Marketplace offers both free and paid Tools. All payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

All prices are displayed in USD unless otherwise indicated. Applicable taxes may be added at checkout as required by your jurisdiction.

If you experience an issue with a paid Tool (e.g., it does not function as described), contact us at support@mcp-marketplace.io and we will work with you to resolve it.

If you publish Tools on MCP Marketplace ("Creator"), the following additional terms apply:

• Commission. MCP Marketplace retains a 15% commission on all revenue generated from paid Tool sales. The remaining 85% is paid to the Creator.
• Payouts. Creator payouts are processed through Stripe Connect Express. Creators must maintain a valid Stripe Connect account in good standing to receive payments. Payout timing and frequency are subject to Stripe's standard processing schedules.
• Tax Responsibility. Creators are solely responsible for reporting and paying all applicable taxes on income received through MCP Marketplace. We may provide tax documentation (e.g., 1099 forms for U.S.-based Creators) as required by law.
• Content Standards. Creators must ensure their Tools comply with all applicable laws, do not infringe upon third-party intellectual property rights, and meet our published submission guidelines. We reserve the right to reject or remove any Tool that fails to meet these standards.
• Representations. By publishing a Tool, you represent that you have all necessary rights and licenses to distribute it, and that it does not contain malware, spyware, or any code designed to harm users or their systems.
• Removal. Creators may remove their Tools from the Marketplace at any time. However, users who have already purchased or installed a Tool retain their existing access. Obligations arising before removal (including pending payouts) survive removal.

The MCP Marketplace platform, including its design, branding, logos, interface, underlying code, and documentation, is the property of MCP Marketplace and is protected by copyright, trademark, and other intellectual property laws.

Creators retain full ownership of their Tools and any associated intellectual property. By publishing a Tool on MCP Marketplace, Creators grant us a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote the Tool within the Marketplace and related marketing materials.

Users are granted a limited, non-exclusive, non-transferable license to install and use Tools obtained through MCP Marketplace for their intended purpose, subject to any additional license terms specified by the Creator.

You may not reproduce, modify, distribute, or create derivative works of the MCP Marketplace platform without our prior written consent.

You agree not to engage in any of the following prohibited activities:

• Violating any applicable local, state, national, or international law or regulation.
• Uploading or distributing Tools that contain malware, viruses, trojans, ransomware, or any other malicious code.
• Attempting to circumvent, disable, or interfere with the Service's security features, including our security scanning systems.
• Scraping, crawling, or using automated means to access the Service or collect data without our express written permission.
• Impersonating another person or entity, or misrepresenting your affiliation with a person or entity.
• Engaging in fraud, including creating fake reviews, inflating install counts, or manipulating search rankings.
• Harassing, threatening, or intimidating other users or Creators.
• Reverse engineering, decompiling, or disassembling the Service's infrastructure or proprietary code.
• Using the Service to distribute spam, phishing content, or unsolicited promotional material.
• Infringing upon the intellectual property rights of others.

Violation of these prohibitions may result in immediate account suspension or termination, removal of listed Tools, and potential legal action.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, or secure; that defects will be corrected; or that any Tools available through the Service are free of viruses or other harmful components.

MCP Marketplace acts as a marketplace platform. We are not a party to transactions between users and Creators, and we make no representations or warranties regarding the quality, safety, legality, or suitability of any Tool listed on the Marketplace.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MCP MARKETPLACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the Service.
• Any Tool obtained through the Service, including any damage to your systems or data.
• Unauthorized access to or alteration of your data.
• Any third-party conduct or content on the Service.
• Any other matter relating to the Service.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless MCP Marketplace from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of a third party, including intellectual property rights.
• Any Tool you publish on the Marketplace (if you are a Creator).

These Terms shall be governed by and construed in accordance with applicable United States federal and state law.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting us at support@mcp-marketplace.io. If a dispute cannot be resolved informally within thirty (30) days, either party may pursue the matter through applicable legal channels.

You may terminate your account at any time by contacting us at support@mcp-marketplace.io or through your account settings.

We may suspend or terminate your access to the Service for violation of these Terms, fraudulent activity, or other conduct that harms the platform or its users. Where practicable, we will provide reasonable notice before termination unless immediate action is necessary to protect the Service or its users.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, indemnification, and governing law.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms, together with our Privacy Policy and any additional terms applicable to specific features of the Service, constitute the entire agreement between you and MCP Marketplace with respect to the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
